During the tender process, the town of Příbram received bids. One of the bidders was disqualified, and a decision has now been made to cancel the tender.
The reconstruction of the wastewater treatment plant (WWTP) is the city of Příbram’s largest investment in financial terms. Following the completion of the project documentation, which envisaged dividing the reconstruction into several phases, a public tender was launched to select a contractor for the works.
During the tender process, the town received three bids; the two final bids were examined by a selection committee comprising experts in the fields of water management and wastewater treatment. On the basis of the selection committee’s recommendation, the tenderer offering a significantly lower price was excluded, on the grounds that their bid did not meet the essential tender conditions. This tenderer lodged an objection to its exclusion and subsequently filed a complaint with the Office for the Protection of Economic Competition (ÚOHS).
In view of the time required for the Competition Authority to reach a decision, the city council decided, on the recommendation of the administrator, to cancel the public contract.
“We are convinced that there was no misconduct in our procedure. We are now in a situation where, given the anticipated duration of the administrative proceedings before the Office for the Protection of Competition, we cannot finalise the public procurement by concluding a contract and proceed with the actual implementation. For this reason, it was decided to terminate the public procurement procedure. It is very important for the town not to delay this investment project, which is why we have followed the recommendations of the experts administering the public procurement procedure. “We will repeat the tender process as soon as the deadlines allow,” says Mayor Jan Konvalinka.
