Joint Notice of Intention (Planning Consent by Notification)

Basic information:
If a developer submits a notification of intention under Section 96 and a declaration of building intention under Section 105 (hereinafter referred to as the ‘joint notification of intent’), the building authority shall issue a joint consent, provided that the requirements and conditions of Sections 96 and 105 are met. The developer shall attach to the joint notice of intent the documents specified in Section 96(3)(a) to (e) and the documentation specified in Section 105(2) to (6), depending on the nature of the project.

In this case, the form for the ‘joint notification of intent’ shall be used instead of the two forms previously submitted – the ‘application for planning permission’ and the ‘notification of works’. (see below)

If the planning authority concludes that the joint notification of a project does not meet the conditions for the issue of planning consent or consent to carry out the notified building project, or if the rights of other persons, apart from those specified in Section 96(3)(d) and Section 105(2)(f), may be directly affected, it shall decide by resolution to conduct a joint planning and building control procedure. The joint planning and building proceedings shall commence upon the resolution becoming final. The joint notice of intent shall be deemed to be an application for the issue of a joint permit.
