Decommissioned vehicles, end-of-life vehicles

Vehicles left parked on roads in the town for long periods

In accordance with Act No. 13/1997 Coll., on roads, as amended, the town of Příbram addresses the issue of abandoned vehicles on local roads as follows:

  • As the owner of the road, and in accordance with Section 19c of the aforementioned Act, it submits a request to the relevant road administration authority to initiate administrative proceedings for the removal of a vehicle wreck located on a local road.
These are cases of a breach of Section 19(2)(g) of the Act on Roads.
  • Where a vehicle is parked on a local road and is not a wreck, but more than six months have elapsed since the date of its last roadworthiness test, the town of Příbram, as the owner of the road, may call upon the vehicle operator to remedy the situation.
In this case, this constitutes a breach of Section 19(2)(h) of the Roads Act, and the town proceeds in accordance with Section 19d of the said Act.

In both instances of this breach of Section 19 of Act No. 13/1997 Coll., by leaving the vehicle on the public highway, the vehicle operator commits an offence under Section 42a(1)(i) (natural person) or Section 42b(1)(i) (legal person or self-employed natural person), and may be liable to a fine of up to 300,000 CZK in administrative proceedings.

  • The Municipal Police shall ascertain the presence of the wreck, document it on the spot and forward a report on the wreck to the Road Management Department (hereinafter ‘OSH’).
  • The OSH, as the competent road administration authority, will initiate administrative proceedings for the removal of the wreck.
  • The OSH will issue a notice to remove the wreck and send it to the vehicle operator – who is obliged to remove the vehicle within two months of receiving the notice (if the notice cannot be delivered to the vehicle operator, it is posted on the official notice board for a period of 2 months; once this period has elapsed without response, the vehicle may be disposed of in an environmentally sound manner).
  • At the same time, the municipal police will affix this notice directly to the vehicle.
  • After two months, the municipal police will check the situation.
  • If the vehicle has not been removed from the road, the OSH will issue an instruction for its environmentally sound disposal.
  • Příbram Technical Services will arrange for the vehicle to be scrapped in accordance with the law.

  • The Municipal Police will identify the vehicle, document the situation on the spot and forward a report on the vehicle to the OSH, which, on behalf of the owner (the town) will identify the vehicle’s operator (in cooperation with the vehicle register) and send them a notice to rectify the situation within two months – the vehicle remains on the road (if the operator does not accept the notice or it cannot be delivered, it will be published on the official notice board, at which point it is deemed to have been delivered, and the two-month period for rectifying the situation begins on the day of publication).
  • Once the deadline has passed, the Municipal Police will assess the actual condition of the vehicle.
  • If the vehicle has not passed its MOT and the owner has not removed it – Technical Services will have it towed to a secure impound car park (on the instructions of the Municipal Police).
  • A notice is sent to the owner informing them of the vehicle’s towing and its storage at the secure car park; at the same time, a notice is sent to the Czech Police.
  • If the owner does not collect the vehicle within 3 months of receiving the notice, the Road Administration Authority (OSH) will, at the request of Technical Services, issue a decision authorising the sale of the vehicle at a public auction.
  • The procedure is then carried out in accordance with Section 19b, paragraphs 4 to 6 and 8.
