Pursuant to Section 125h(1) of the Road Traffic Act, the municipal authority with extended powers shall, without delay after the detection or notification of an offence, require the operator of the vehicle with which the offence was committed to pay the specified amount, provided that:
- the breach of the rules was detected by an automated technical device operating without an operator and the breach did not result in a road traffic accident,
- the identity of the driver of the vehicle is unknown or is not apparent from the evidence forming the basis for initiating proceedings for the offence,
- the breach can be dealt with by imposing a fine by means of an on-the-spot penalty notice.
If the above conditions are met, a ‘Notice to Pay the Specified Amount’ is sent to the vehicle operator. The vehicle operator either pays the specified amount, in which case the matter is concluded without an entry being made on the driver’s record card and no penalty points are awarded, or may provide the administrative authority with details of the driver of the vehicle at the time the offence was committed (the form for providing the driver’s details is available here). If the driver is identified on the basis of the information provided, administrative proceedings for the offence will be initiated against them, which will result in the imposition of an administrative penalty; this will be recorded on the driver’s record card and will result in penalty points.
If the vehicle operator provides the administrative authority with only incomplete details of the driver, or states that the vehicle was driven by a relative, or if the documents cannot be served on the identified person, or if that person is unable to prove the offence, the administrative authority shall dismiss the case after 60 days and initiate proceedings for an offence directly against the vehicle operator for breach of the obligations imposed on them by Section 10 of the Road Traffic Act.
Under Section 125f(6) of the Road Traffic Act, the vehicle operator shall not be held liable for the offence only if:
- at the time prior to the commission of the offence, their vehicle had been stolen, or
- its number plate bearing the allocated registration number had been stolen; or
- they had submitted an application for the change of vehicle operator to be recorded in the Road Vehicle Register.
The vehicle operator is the owner or any other person registered as the operator in the Road Vehicle Register.
