Where to apply:

Basic information:

A permit from the water authority is required for the construction of waterworks (domestic wells), for alterations to them and changes to their use, as well as for their removal.

Processing time:

Within 60 days, or within 90 days in particularly complex cases, from the start of the proceedings.

Who is authorised to submit an application, notification, etc.:

The developer or their representative (by power of attorney).

Other parties to the proceedings:

• the local authority,
• the river basin authority (if the decision is likely to affect water conditions in the river basin),
• persons who have ownership or other rights to the land and buildings thereon, including persons who have ownership or other rights to neighbouring land and buildings thereon, and whose rights may be directly affected by the planning permission,
• or others, as applicable.

Procedure under the Administrative Procedure Code:

The permit is issued through administrative proceedings.

Administrative (or other) fee:

• construction of a well: 300 Kč
• for the issue of an additional permit for the construction of a well: 300 + 300 CZK, plus a fee for an on-site inspection – 500 CZK for each hour or part thereof during the administrative authority’s working hours.

Remedies:

The proper remedy is an appeal. The decision issued contains instructions on how to appeal, specifying the time limit within which an appeal may be lodged, the authority to which it should be addressed, and where the appeal may be lodged.
