Basic information:

This is a procedure whereby a valuable tree may be designated as a heritage tree, thereby ensuring greater protection for it under the law.

Who is entitled to submit an application, notification, etc.:

Anyone may submit a proposal to designate a tree as a heritage tree. The nature conservation authority may initiate administrative proceedings on the basis of a proposal or on its own initiative.

Other parties to the proceedings:

Owners and co-owners of the land, or those whose rights, legally protected interests or obligations are to be dealt with in the proceedings, or whose rights, legally protected interests or obligations may be affected by the decision. The local authority is always a party to the proceedings.

• Act of the Czech National Council No. 114/1992 Coll., on the Protection of Nature and the Landscape, as amended,
• Decree of the Ministry of the Environment of the Czech Republic No. 395/1992 Coll., implementing certain provisions of Act No. 114/1992 Coll., as amended,
• Act No. 500/2004 Coll., the Administrative Procedure Code, as amended.

Remedies:

The proper legal remedy is an appeal. The decision issued contains instructions on how to appeal, setting out the time limit within which an appeal may be lodged, the authority to which it should be addressed, and where the appeal may be lodged.
