Approval by the Agricultural Land Fund (ZPF) authority of the proposed route

Basic information:

The developer of overhead and underground utility lines, roads, national railways and waterways, and their components, is obliged to propose the location of the structure in such a way so that, from the perspective of the protection of agricultural land and other public interests protected by law, the loss of agricultural land is minimised, whilst also assessing the impact of the proposed solution on this land. The authority responsible for the protection of agricultural land shall always give its opinion on the proposed routes, and in its opinion shall propose measures to ensure the protection of agricultural land.

Such an opinion is not required:

• if the route is to be constructed on land designated for this purpose by the applicable spatial development principles or the applicable local plan, or if the conditions for the route’s location are set out in a regulatory plan,
• where route proposals form part of a solution contained in the documentation for other works for which consent to land acquisition has been granted under Section 9,
• where the proposal concerns modifications to routes, or
• where the matter concerns adjustments to the alignment, width and curve parameters of existing overhead and underground lines, roads, national railways and waterways.

Time limit for processing:

In straightforward cases, without delay; in other cases, within 30 days; and in particularly complex cases, within 60 days of the commencement of proceedings.

Who is authorised to submit an application, notification, etc.:

An application for approval of a proposed route is submitted by the project investor or, where applicable, by a natural or legal person authorised by the investor on the basis of a power of attorney.

• Act No. 334/1992 Coll., on the protection of agricultural land, as amended
• Decree No. 271/2019 Coll., on the establishment of procedures to ensure the protection of the agricultural land fund.

Procedure under the Administrative Procedure Code:

The opinion constitutes preliminary information pursuant to Section 139 of the Administrative Procedure Code regarding the conditions for granting consent to the withdrawal of agricultural land from the Agricultural Land Fund.
