Unmarried couple – child maintenance and provision for the payment of certain costs to the unmarried mother

If the child’s mother is not married to the child’s father, the child’s father shall provide her with maintenance for a period of two years from the child’s birth and shall contribute, to a reasonable extent, towards the costs associated with pregnancy and childbirth. The obligation to cover costs associated with pregnancy and childbirth arises for the man whose paternity is probable, even if the child is not born alive. The court may, at the request of the pregnant woman, order the man presumed to be the father to provide in advance the sum required for maintenance and a contribution towards the costs associated with pregnancy and childbirth. The court may also, at the request of the pregnant woman, order the man presumed to be the father to provide in advance the sum necessary to ensure the child’s maintenance for the period during which the woman would be entitled to maternity leave as an employee.

Maintenance for an unmarried mother and reimbursement of costs associated with pregnancy and childbirth may also be awarded retrospectively, but for a maximum of two years from the date of birth.

Maintenance is paid in regular instalments and is always payable one month in advance. However, the child’s father and the child’s unmarried mother may agree on a different payment schedule.
