Issuance of a public document of identification
Where to deal with this matter:
Příbram Town Hall, Department of Civil Affairs, Registry, Ceremonies and Celebrations Section, Gen. R. Tesaříka 19, 261 19 Příbram I, 1st floor, door no. 213.
Basic information:
The purpose of identification is to establish measures against the legalisation of proceeds of crime and to prevent illegal flows of money derived from criminal activity via fictitious individuals and companies. For certain agreements, transactions and business dealings, it is necessary to specify the parties involved in more detail. Therefore, the law imposes an obligation on obliged entities to identify them. Identification means ascertaining the identity of the person being identified using data specified by law and drawing up an identification document, which has the status of a public document. The identified client is always a natural person who is a party to the transaction or who acts on behalf of a legal person.
Obligated entities:
Obligated entities are specified by law and include, in particular, banks, building societies, insurance companies, currency exchange bureaux, credit institutions, casinos, estate agents, as well as second-hand shops and pawnbrokers. Furthermore, all business entities accepting cash payments in excess of 15,000 euros.
Identification by a third party:
• representation by power of attorney, where the authorised representative of the obliged entity is identified.
• identification on behalf of the obliged person is carried out by a notary, or, by delegated authority, by a regional authority or
a municipal authority with extended powers
Data to be verified:
• for a natural person: first name and surname, personal identification number, gender, permanent or other place of residence; the number and expiry date of the identity document
and the authority or country that issued it;
• for legal entities and self-employed natural persons, the business name, including any distinguishing suffix, the registered office and the
identification number are verified; the first name, surname, personal identification number and permanent residence of the statutory body or its member must be provided; the majority shareholder or controlling person must be specified, along with the identification of the natural person acting on behalf of the company in the transaction in question.
Procedure:
The natural person to be identified must attend the relevant authority with the required documents and certificates. An authorised official of the authority, carrying out the identification, will assess these documents and, on that basis, draw up an identification certificate. This certificate is a public document, and copies of all the documents from which the identification details were obtained are integral parts of it. The authority keeps precise records of the identifications carried out and the public identification certificates issued.
Required documents and certificates:
An application for identification from the obligated party, the consent of the identified person to the identification and to the inclusion of their personal data in the certificate. A photo ID (identity card, passport). Proof of permanent or other residence, if
not stated in the document submitted. In the case of a representative of a party to the transaction, a power of attorney with an officially certified signature; and in the case of legal entities and self-employed individuals, an extract from the Commercial Register.
Who is authorised to submit applications, notifications, etc.:
• The obliged entity shall request mediated identification of all parties to the transaction from the authority authorised to carry out identification. The parties must be named by the obliged entity in the application, and the application must always clearly state the purpose of the identification;
• the person being identified, appearing in person at the authorised authority, shall declare that the identification is to be carried out at the request of a specific, precisely identified obliged entity and, in their declaration, shall provide the authority with the information required by law and clearly state the purpose
of the identification,
• Identification always requires the personal presence of the person being identified,
• Identification is not tied to the place of residence of a natural person or to the registered office of a legal entity.
Form available at:
The application for identification and the declaration by the person being identified are provided by the obliged entities requesting the identification.
Time limit for processing:
Identification and the drawing up of a public document shall be carried out without undue delay, subject to agreement between the parties involved.
