Basic information:

This is a procedure in which the state forestry authority may, in justified cases (e.g. endangered forest stands, forest stands of preparatory/fast-growing tree species) may, when drawing up the management plan or at the request of the landowner, grant an exemption from the ban on clear-cutting (Section 33(6) of the Forest Act).

Time limit for processing:

In straightforward cases, without delay; in other cases, within 30 days; and in particularly complex cases, within 60 days of the commencement of the proceedings.

Who is entitled to submit an application, notification, etc.:

Proceedings are initiated on the basis of a written application from the forest landowner.

Other parties to the proceedings:

Any co-owners of the land.

Legislation governing the procedure:

• Act No. 289/1995 Coll., on forests and amending and supplementing certain acts (the Forest Act), as amended
• Act No. 500/2004 Coll., the Administrative Procedure Code, as amended.

Administrative (or other) fee:

No administrative fee is charged for the issue of a decision.

Remedies:

The proper remedy is an appeal. The decision issued contains instructions specifying the time limit within which an appeal may be lodged, the authority to which it should be addressed, and where the appeal may be lodged.
