Basic information

If a child is born to an unmarried, divorced or widowed mother, paternity may be established

  • if a child is born between the date of marriage and the expiry of the 300th day following the dissolution of the marriage, or following its annulment, the mother’s husband is deemed to be the father,
  • if a child is born to a woman who has remarried, her subsequent husband is deemed to be the father, even if the child was born before the expiry of the 300th day following the dissolution of her previous marriage or its annulment,
  • when calculating the period relevant for determining paternity, the marriage of a person who has been declared dead shall be deemed to have ended on the date specified as the date of death in the declaration of death;
  • otherwise, the father is deemed to be the man whose paternity has been established by a joint declaration of the parents, made before the registry office or before a court,
  • a declaration of paternity by a minor parent must always be made before a court.

Procedure

As this involves a so-called joint declaration by the parents, both parents must appear in person at the registry office.

Time limit for processing

  • A joint declaration by the parents may be made before the child’s birth or within 30 days of the birth, prior to registration in the register of births;
  • a subsequent determination of paternity may be made at any time.

Legislation governing the procedure

  • Act No. 301/2000 Coll. on registers, first names and surnames, and on amendments to certain related acts,
  • Decree No. 207/2001 Coll., implementing Act No. 301/2000 Coll. on registers, first names and surnames, and amending certain related Acts,
  • Act No. 89/2012 Coll., the Civil Code.
