Town of Příbram
Town Hall address: Tyršova 108, 261 19 Příbram
Company registration number: 002 43 132
The protection of natural persons in relation to the processing of personal data is a fundamental right. Article 8(1) of the Charter of Fundamental Rights of the European Union and Article 16(1) of the Treaty on the Functioning of the European Union recognise the right of every person to the protection of personal data concerning them. The processing of personal data of natural persons (‘data subjects’) by the Data Controller is carried out for the benefit of those persons. However, the right to the protection of personal data is not an absolute right; it must be assessed in the context of its function in society and, in accordance with the principle of proportionality, must be balanced against other fundamental rights.
The Data Controller processes personal data and other information relating to citizens and other data subjects within the scope of its independent and delegated powers. Most of the data subjects’ personal data is therefore processed on the basis of obligations imposed on the Municipal Authority by specific laws or, where applicable, by contracts. Such processing of personal data relating to data subjects is not subject to the requirement to obtain the consent of those individuals. Where certain personal data are processed outside the scope of a statutory obligation, such processing is subject to the consent of the citizens. However, the District Office carries out such processing only in exceptional cases (e.g. when organising events where prior registration is required).
The protection of personal data applies to both automated and manual processing of personal data. In the principles and rules for the protection of natural persons which the Municipal Authority applies in connection with the processing of a data subject’s personal data, the Municipal Authority respects their fundamental rights and freedoms, in particular the right to the protection of personal data. The Data Controller respects the rights of citizens as guaranteed by law, such as the right to know and be informed, in particular regarding the purpose for which personal data are processed and, where applicable, the period for which they will be retained. The principles of personal data protection apply to all information relating to an identified or identifiable natural person. The Data Controller lawfully processes personal data because such processing is necessary for the performance of tasks carried out in the public interest or in the exercise of official authority vested in the Data Controller, or on the grounds of the legitimate interests of the Data Controller or a third party. The Municipal Authority processes citizens’ personal data in accordance with the purposes of processing and in compliance with the applicable legislation on the protection of personal data, in particular Act No. 110/2019 Coll., on the Protection of Personal Data, as amended, and EU Regulation 2016/679 (General Data Protection Regulation – GDPR). Nevertheless, every data subject has the right to object to the processing of personal data relating to their specific situation. The Data Controller will then demonstrate to the data subject the seriousness and legitimacy of the Data Controller’s interests, which do not interfere with the interests or fundamental rights and freedoms of the data subject.
How we process personal data
The processing of personal data by the Data Controller is carried out in a lawful and fair manner; it is transparent to data subjects; and information and all communications relating to the processing of such personal data are easily accessible, comprehensible and provided in clear and simple language. When processing personal data on the basis of a natural person’s consent, those individuals are made aware of any risks arising from the processing, as well as the rules, safeguards and rights that exist in connection with the processing of their personal data. The purposes for which personal data are processed are unambiguous and legitimate, and are specified at the time the personal data are collected. The scope of the personal data collected is always proportionate, relevant and limited to the data necessary to fulfil the specified purpose. Likewise, the period for which personal data is retained is limited to the strict minimum. In all processing of personal data, measures are applied to ensure the appropriate security and confidentiality of such data (e.g. measures to prevent unauthorised access to personal data and to the equipment used for its processing).
The OÚ controller, as the data controller within the meaning of Article 4(7) of Regulation (EU) (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), is responsible for any processing of personal data and, based on an assessment of the likely and significant risks associated with such processing, has implemented appropriate and effective technical and organisational measures to ensure the protection of personal data. The measures for safeguarding personal data also include regular training for staff who process personal data. Staff at all levels are required to adopt a responsible, proactive and creative approach and to comply with the rules governing personal data security systems.
In connection with the transition to the new EU data protection legislation, i.e. EU Regulation 2016/679 (GDPR), the Data Controller carried out a new data protection impact assessment of all processing activities, with the aim of assessing the specific likelihood and severity of risks. In carrying out this assessment, the Data Controller took into account the nature, scope, context and purposes of the processing, as well as the sources of risk. The measures to secure systems, information, data and personal data, and the specific technical, organisational and security measures which the Data Controller has adopted and is continually refining to ensure compliance with the EU Regulation have been further elaborated in this context in the Data Controller’s internal documents and guidelines. These measures also include the appointment of a Data Protection Officer.
