Notice to applicants and beneficiaries:
On 1 August 2012, the Guide for Applicants and Beneficiaries relating to Intervention 5.2 ‘Improvement of the environment in problem housing estates’ and its annexes were updated.
The updated Guide for Applicants and Beneficiaries, including its annexes, can be found in the files at the bottom of this page.
Based on a notification from the Ministry of Regional Development of the Czech Republic, it is possible to change the owner of a residential unit without the consent of the IOP Managing Authority. However, the applicant is obliged to report the transfer of the flat(s) in question as part of the Sustainability Report. This is a supplement to the notification from the Ministry of Regional Development of the Czech Republic set out below.
Notice to applicants and beneficiaries (additional information from the IOP Managing Authority) regarding a change in the applicant’s legal status:
Based on assessments by the Ministry of Finance of the Czech Republic (MF ČR) and the Housing Policy Department of the Ministry of Regional Development of the Czech Republic (Ministry for Regional Development of the Czech Republic), the IOP Managing Authority (Managing Authority of the Integrated Operational Programme) must state that, during the sustainability period, a change in the legal status of a grant beneficiary pursuant to Section 14a of Act No. 218/2000 Coll. is only possible if the change is in accordance with Section 23(2) of Act No. 72/1994 Coll.
This means that the tenant submitted a request for the transfer of the flat by 30 June 1995, and the ownership of the flats by the original co-operative in the building ceases in whole or in part. This applies to building housing cooperatives and people’s cooperatives that were established before 1989 and managed state property. Where not all flats in the building are transferred, the building housing cooperative becomes a member of the Owners’ Association or a newly established cooperative.
The transfer of flats is contrary to the provisions of Section 14a of Act No. 218/2000 Coll. where the Owners’ Association is established following the dissolution of a housing co-operative which had previously been established following the transfer of flats pursuant to Section 23(2) of Act No. 72/1994 Coll. In this case, the transfer of flats, or a change of beneficiary, cannot be permitted during the project’s sustainability period.
In general, it must therefore be noted that if the grant beneficiary decides to change the legal form of the ‘grant beneficiary’, this would only be possible if the housing cooperative in question has not yet been ‘privatised’ in accordance with Act No. 72/1994 Coll., Section 23(2). In the case of housing cooperatives that have already undergone this change, a change in the grant recipient (a change in the recipient’s legal status) cannot be authorised by the IOP Managing Authority, as this would be contrary to Act No. 218/2000 Coll. If, despite this, the change were to be implemented, the grant recipient would be in breach of the conditions of the Grant Award Decision.
During the sustainability period, it is, of course, possible to change the owner of a specific housing unit, subject to the approval of the IOP Managing Authority.
Notice to applicants and beneficiaries:
The Managing Authority of the Integrated Operational Programme (IOP MA) recently dealt with a case involving a grant recipient under Measure 5.2(b) – Regeneration of Block Flats, who submitted a ‘Notice of Change’ to the project concerning a change in the recipient’s legal status.
During the project’s sustainability period, the housing co-operative agreed to change its status to an owners’ association. Following consultation with the Ministry of Finance of the Czech Republic, the IOP MA concluded that, in this case, the change would be contrary to the applicable conditions for the award of the grant. There is no legal instrument that would permit a change in the beneficiary to whom funds were granted by the ‘Decision on the Grant of a Subsidy’.
In the event of a conversion from a housing co-operative to an owners’ association, there is a risk of losing entitlement to the entire grant or having to repay the grant.

Recommendation from the Centre for Regional Development dated 26 February 2010:
The Centre for Regional Development (CRR) strongly recommends that applicants – beneficiaries – consult their local CRR branch regarding their project proposals before finally submitting their Benefit Application. Ideally, an electronic version of the application should be sent by email to the CRR project manager, Mr Miloš Jírů (jiru@crr.cz). It is also possible to arrange a face-to-face meeting with the project manager at the CRR branch in Prague.
Announcement from the Centre for Regional Development:
Issues relating to Category 1 small-scale contracts
Small-scale contracts in Category 1 (i.e. contracts with an estimated value of up to 500,000 CZK excluding VAT), which may be awarded by direct purchase in accordance with the Guide for Applicants and Beneficiaries, do not need to be entered into Benefit by the applicant. This means that applicants will not tick the box ‘The project involves a tender procedure’ in Benefit, and consequently the ‘Tender Procedures’ tab will not be activated.
Frequently asked questions (FAQs) from applicants are available on the Centre for Regional Development’s website:
