Fireworks announcement
The organisation of a fireworks display must be notified to the local (municipal) authority, the locally competent fire and rescue service and the district mining authority!
Under Act No. 206/2015 Coll., on pyrotechnic products and their handling, as amended (hereinafter referred to as ‘the Act’), institutions, legal entities or natural persons to notify the relevant local authority, the relevant regional fire and rescue service and the district mining authority in writing, no later than 5 working days before the fireworks display takes place (7 working days before the fireworks display takes place).
The notification of a fireworks display (fireworks activities) must be in writing using the form provided here, and must be accompanied by the written consent of the landowner on whose land the fireworks are to be set off, or, where applicable, the consent of the owners, managers or users of other affected properties to the fireworks display.
Fireworks (or a fireworks display) must be carried out by a business entity or a person with the necessary professional qualifications.
What is a fireworks display?
According to Section 3(v) of the Act, a fireworks display is defined as the simultaneous or rapidly successive setting off of pyrotechnic articles of categories F2, F3 (recreational pyrotechnics) and T1 (theatrical pyrotechnics) as set out in Annex 1 to the Act.
The setting off of pyrotechnic articles with a total net content of explosive substances not exceeding 10 kg is not considered to be a fireworks display.
It follows from the above that if the planned ‘small New Year’s Eve fireworks display’ consists of pyrotechnic articles with a total net explosive content not exceeding 10 kg, there is no obligation to notify the local (municipal) authority.
What is a fireworks display?
According to Section 3(v) of the Act, a fireworks display is defined as an activity in which pyrotechnic articles of category F4 or T2 are used to produce light, sound, smoke or a combination of these effects, including the preparation and execution of these effects.
Permit for pyrotechnic work
Unless otherwise specified, fireworks displays may only be carried out on the basis of a fireworks display permit issued by the district mining authority; see the Act.
Within the territory of the town of Příbram, the Generally Binding By-law of the Town of Příbram on the Regulation of the Handling of Pyrotechnic Articles applies, which significantly restricts the staging of fireworks displays within the town, both in terms of location and time. It can be found in the Collection of Legal Regulations of Local Authorities; see https://sbirkapp.gov.cz/.
